Warranty Claim Denied? Your Rights Under Consumer Law

If a company refuses to honour your warranty, you may have a defect, a deficiency in service, or both. Here is how to tell and what to do.

When your warranty claim denied letter arrives, it can feel final. It is not. The Consumer Protection Act, 2019 treats a wrongly refused warranty claim as a problem you can take to a Consumer Commission. The key is to understand two terms the Act uses, a defect and a deficiency in service, because they shape how you frame the complaint.

Defect versus deficiency

Section 2(10) defines a defect as a fault, imperfection or shortcoming in the quality, quantity, potency, purity or standard of goods, whether required by law, by contract, or as claimed by the trader. A defect relates to goods.

Section 2(11) defines deficiency as a fault, imperfection, shortcoming or inadequacy in the quality, nature and manner of performance of a service. A deficiency relates to services.

Many warranty disputes involve both. The phone that stops working in month three has a defect. The service centre that refuses to repair it under warranty, or keeps you waiting for weeks, may be guilty of deficiency in service. You can raise both in one complaint.

Get the denial in writing

Ask the company or service centre to give the reason for refusing in writing. Common reasons include physical damage, repair by a third party, an expired warranty, or use of accessories. Ask for the inspection report. If they refuse to put it in writing, record your request by email and keep the date.

Keep the paper trail

  • the invoice and the warranty card,
  • the service request or job sheet and ticket number,
  • photographs and videos of the fault,
  • the service history,
  • every message with the company and the service centre.

Who to name

Name the manufacturer, the seller and the authorised service centre, as the facts require. Each may have a different part in the problem. Who is finally responsible is decided by the Commission on your evidence.

What you can ask for

Depending on the case, a Commission can order the defect to be removed, the goods to be replaced or the price refunded, along with compensation and costs. State clearly what you want and add up the amounts.

Send a notice

Write to the company giving them 15 days to honour the warranty or refund. The format in our consumer complaint letter guide works well here.

Where to file

File in the District Commission where you live if you paid up to ₹50 lakh. See which consumer commission to approach. Claims up to ₹5 lakh have no fee, as set out in consumer court fees. File on the e-Jagriti portal, and read e-Daakhil to e-Jagriti if you have not used it before.

Mind the clock

You have two years from the cause of action under Section 69, and that is usually the date the claim was refused or the problem first appeared. See the consumer complaint time limit guide.

If your warranty claim denied letter gives a reason you disagree with, ask for the inspection report and keep every reply.
